Terms of sale
These terms and conditions govern all orders placed, on the one hand, by any person wishing to make a purchase on the website www.supernutrition.fr, hereinafter referred to as the “Customer”, and, on the other hand, by the company SUPERNUTRITION, a simplified joint-stock company (SAS) whose registered office is located at 208 Rue du Galet de Gargantua, 01220 Divonne-les-Bains, hereinafter referred to as “Supernutrition”. These General Terms and Conditions of Sale are the only terms applicable and replace all other conditions, unless expressly agreed otherwise in writing in advance. Supernutrition reserves the right to modify certain provisions of its General Terms and Conditions without prior notice. Consequently, the applicable terms are those in force on the website at the time the order is placed. These terms apply exclusively to non-commercial natural persons.
1. PRICES
All product prices are indicated in euros, all taxes included, excluding any contribution to shipping costs. Shipping fees will be indicated before the order is placed. VAT is applied at the rate in force at the time the order is placed. Supernutrition reserves the right to change its prices at any time; however, products will be invoiced on the basis of the rates in force at the time the order is registered by the Customer. The products remain the property of Supernutrition until full payment of the price by the Customer.
2. ORDERS
The Customer may place orders on www.supernutrition.fr 24 hours a day, 7 days a week, except during site updates. The ordering process takes place in several steps:

the Customer fills the shopping cart with products,

the Customer chooses the delivery method,

the Customer chooses the payment method,
-
the Customer submits the payment request.
The order is completed, after acceptance of the General Terms and Conditions of Sale, as soon as the Customer has registered the order by clicking on the “Confirm my order” icon.
The Customer will receive an order confirmation by email.
Supernutrition reserves the right to cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order or who presents any form of risk in its opinion. Supernutrition undertakes to honor orders received on the website only while stocks last. In the event of product unavailability beyond Supernutrition’s control, the Customer will be informed as soon as possible by email. The Customer may then cancel or modify the order.
3. VALIDATION
The Customer declares having read the General Terms and Conditions of Sale prior to validating the order. All data provided and the recorded confirmation shall constitute proof of the transaction. You declare that you are fully aware of them.
4. PAYMENTS
The Customer may pay for purchases by credit card (Visa, Carte Bleue, Mastercard), PayPal account, or bank transfer. Supernutrition guarantees the security of credit card payments by using the TLS (Transport Layer Security) encryption protocol and the STRIPE solution. In addition to verification of the card number, expiry date and security code, with the 3D-Secure system the cardholder must authenticate with their own bank by providing a code or personal information.
5. DELIVERY
Products can only be delivered in Metropolitan France and Corsica to the delivery address provided by the Customer when placing the order. The Customer may also choose delivery to a pick-up point (relay point) of their choice. Supernutrition offers the following delivery or collection options:

delivery by COLISSIMO,
-
delivery to a pick-up point.
The Customer may cancel the order and be fully refunded within a maximum of 14 days in the event of a delay of more than 7 days beyond the delivery date. This period starts from the Customer’s request.
6. SHIPPING FEES
Shipping fees are detailed on the “Delivery Conditions” page.
7. DELIVERY TIME
Any order placed before 3:00 p.m. will be shipped the same day, excluding public holidays and weekends. For delivery in Metropolitan France, the delivery time is 48–72 hours (business days). Supernutrition declines all responsibility for any extension of delivery times caused by the carrier.
8. RIGHT OF WITHDRAWAL
In accordance with the applicable legal provisions, the Customer has a right of withdrawal of fourteen (14) clear days from the date of receipt of the order, provided that the products are returned in their original packaging and in perfect condition, allowing them to be resold.
The Customer exercising the right of withdrawal must send an email to customer service at: contact@supernutrition.fr.
Return shipping costs are borne by the Customer.
9. REFUND
In the event the right of withdrawal is exercised, Supernutrition shall refund the Customer all sums paid, including the original delivery costs (excluding return costs), no later than fourteen (14) days from the date on which it is informed of the Customer’s decision to withdraw.
10. DAMAGED PARCEL
The Customer must check the external condition of the parcel and the condition of the items upon delivery. If, at the time of delivery, the original packaging is damaged or opened, the Customer must ensure that the products are intact. If they are damaged, the Customer may make a reservation or submit a claim to Supernutrition.
The Customer must inform Supernutrition by email at: contact@supernutrition.fr within a maximum of 48 hours. If no reservation was made on the delivery note and the Customer notices upon opening the parcel that the products are damaged, the Customer must inform Supernutrition by email within 48 hours and must attach:
-
a photograph of the exterior of the parcel,

a photograph of the damaged product.
11. PRODUCT WARRANTY
The Seller remains bound to its Customers by the statutory warranty of conformity of the products with the contract under the conditions of Article L217-4 et seq. of the French Consumer Code and the warranty against hidden defects under Articles 1641 to 1648 and 2232 of the French Civil Code.
The Customer may request the statutory warranty of conformity from Supernutrition by email at: contact@supernutrition.fr.
When acting under the statutory warranty of conformity, the Customer:
-
benefits from a period of two (2) years from delivery of the goods to take action;
-
may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L217-9 of the French Consumer Code;
-
is not required to prove the existence of the lack of conformity of the goods within twenty-four (24) months following delivery of the goods, except for second-hand goods.
The statutory warranty of conformity applies independently of any commercial warranty that may have been granted.
The Customer may also decide to invoke the warranty against hidden defects within the meaning of Article 1641 of the French Civil Code and, in this case, may choose between cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the French Civil Code.
The Seller is subject to the statutory warranty provisions set out in Articles L217-4, L217-5 and L217-12 of the French Consumer Code and Articles 1641 and 1648 of the French Civil Code.

12. LIABILITY
Supernutrition declines all responsibility in the event of improper use of the products. The Customer must strictly comply with the instructions indicated on the packaging. Supernutrition’s warranty is limited to the refund or replacement of non-compliant products.
13. FORCE MAJEURE
Any circumstances beyond the control of the parties preventing performance of their obligations under normal conditions shall be considered causes for exemption and shall result in the suspension of those obligations.
Events considered as force majeure include all irresistible, external, unforeseeable and unavoidable events beyond the control of the parties that cannot be prevented despite all reasonably possible efforts, including, but not limited to: disruption of transport or supply, earthquakes, fires, storms, floods, lightning, interruption of telecommunications networks or difficulties specific to external telecommunications networks.
The parties shall consult each other to assess the impact of the event and agree on the conditions under which performance of the contract will continue. If the force majeure event lasts more than three (3) months, these General Terms and Conditions may be terminated by the affected party.
14. APPLICABLE LAW / DISPUTES
These General Terms and Conditions of Sale are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction. In all cases, the parties may resort to a conventional mediation procedure in the event of a dispute.
15. INTELLECTUAL PROPERTY
The website Supernutrition.fr is protected by intellectual property rights. Any reproduction, exploitation or use of images, fonts or illustrations may give rise to legal proceedings.
